ARTICLE 1: COMPANY

DOMAINE DE LOCGUÉNOLÉ offers accommodation, catering, spa treatments and seminar room hire at its eponymous hotel in KERVIGNAC.
DOMAINE DE LOCGUÉNOLÉ operates the site www.locguenole.com (hereinafter referred to individually as the "Site")
ARTICLE 2. PURPOSE
These Terms and Conditions of Service (the " CGS ) apply, without restriction or reservation, to all services, booked by telephone, or following the signing of a quotation or directly at the hotel or spa reception desk, provided by DOMAINE DE LOCGUÉNOLÉ (hereinafter the " Services "). Services ) for the benefit of its professional or consumer customers (hereinafter referred to as the "Customer(s)"). Customer(s) ").
Certain stipulations of these GTS may vary depending on whether the Customer is a professional or a consumer.
In particular, the GTS specify the conditions for placing orders, making payments and performing the Services ordered by Customers, as well as all the obligations of the parties in the context of performing the Services.
The GCS apply to the exclusion of all other conditions. They are communicated to the Customer with the quotation and in any event before any reservation by e-mail and take precedence, where applicable, over any other version or any other contradictory document.
Any other conditions emanating from the Client, provided that they are not in contradiction with the present conditions, will only be valid if they have been accepted by DOMAINE DE LOCGUÉNOLÉ, in a prior and express manner.
The Customer declares that he has read and accepts the GST by ticking the " " box. I have read the General Terms of Service and the Privacy Policy, and confirm that I understand and accept them. ".
The consumer Customer declares that he/she is acting for personal purposes that do not fall within the scope of his/her commercial, industrial, craft, liberal or agricultural activity, and that he/she has full legal capacity to enter into commitments under these general terms and conditions of service.
Validation of the booking implies acceptance by the Customer of these GTS.
Prior to making a reservation, the Client declares that he has obtained from DOMAINE DE LOCGUÉNOLÉ all the necessary information on the Site or from the hotel services in order to make his reservation with full knowledge of the facts.
The fact of not exercising, at any time, a prerogative recognised by the GTS, or of not requiring the performance of any stipulation of the agreement resulting from the said conditions may not under any circumstances be interpreted, either as a modification of the contract, or as an express or tacit waiver of the right to exercise the said prerogative in the future, or of the right to require the scrupulous performance of the commitments entered into herein.
All Clients are advised to save and print these GST using the standard functions of their browser and computer. DOMAINE DE LOCGUÉNOLÉ reserves the right to modify or supplement, at any time, all or part of these GTS. In this case, the new version of the GTS will be available on the Site with its date of entry into force. Customers are advised to consult the GTS regularly to take note of any changes. In any event, the Customer will only be bound by the version of the GTS in force at the time the Customer books the Service.
ARTICLE 3. DESCRIPTION OF SERVICES - BOOKING
DOMAINE DE LOCGUÉNOLÉ offers on its Website various Services including hotel room reservation servicess and suites, as well as other Services.
Details of the Services may be consulted at the hotel and are also described on the "domaine-locguenole.com" website (the Site), and are in any event sent with the quotation, when the reservation is made at the hotel and in the confirmation e-mail.
3.1 Accommodation services
The essential characteristics of the Services offered, the dates of availability, the price, the options, the terms of payment, as well as the special conditions relating in particular to cancellation policies and conditions, time of arrival, access to Wi-Fi, the admissibility of pets (to be kept on a lead and excluding access to the restaurant, the spa and the seminar rooms) etc. are communicated to the Customer before any reservation is made.
These special conditions are communicated to the Customer before any booking is made.
The rooms and suites offered for reservation and presented on the Site are described by category, mentioning their essential characteristics within the meaning of article L. 111-1 of the French Consumer Code. The photographs displayed on the Site faithfully present the level of facilities and amenities of each category of room. However, the room allocated to the Customer may differ slightly from the room used as an illustration on the Site.
3.2 Services that are complementary to or independent of accommodation
DOMAINE DE LOCGUÉNOLÉ also offers complementary or independent services that can be booked online, including breakfast, catering in the L'INATTENDU and LA MAISON ALYETTE restaurants, wine tasting services, Spa treatment services, combined packages, seminar rooms and study days.
The hotel also offers yoga classes, a concierge service, babysitting on request and free indoor parking for all room, restaurant and spa reservations.
These services (yoga, concierge, baby-sitting, parking) must be booked at the hotel reception desk and will be invoiced in addition to the price of the accommodation at the conditions applicable on the day they are booked.
3.3 Spa
DOMAINE DE LOCGUÉNOLÉ also offers a complete range of body and facial treatments in collaboration with the brands SOTHYS, KOS, NOUGATINE, OPI, or any other partner. The identity of the partner brand may change.
3.4 Gift packs and vouchers
The DOMAINE DE LOCGUÉNOLÉ also offers tailor-made gift vouchers to be spent at the hotel, restaurant or Spa.
Each gift voucher is described on the Site. This description mentions the essential characteristics within the meaning of article L. 111-1 of the French Consumer Code.
The photographs on the Site do not constitute a contractual document.
A description of the characteristics of the Service is sent to the Customer before the booking is made.
Gift vouchers are valid for 1 year from the date of purchase. If the validity date is exceeded, no reimbursement will be made, except in exceptional cases (health crisis, closure, etc.) when, with the Customer's agreement, the validity period of the voucher may be extended or reimbursed.
Furthermore, the company DOMAINE DE LOCGUÉNOLÉ does not under any circumstances guarantee the availability of the Services on the days and at the times requested by the Customer, in particular in the event of a reservation close to the expiry date of the voucher. It is strongly recommended to book well in advance of the expiry date of the gift voucher.

3.5 Seminar and banquet rooms
DOMAINE DE LOCGUÉNOLÉ has 2 seminar and trade fair rooms, the details of which can be found on the website https://www.domaine-locguenole.com/seminaires-evenements-salle-de-reception-morbihan/professionnels-seminaire-bretagne/ and by e-mail, particularly when the quotation is being drawn up.
Seminar and banquet rooms are booked exclusively through the Backyou platform.
The Client may, at any time during the reservation process, request further information from DOMAINE DE LOCGUÉNOLÉ.
The quotation is sent to the Customer before any booking is made.
The seminar rooms and lounges are available at the times agreed in the quote.
If these times are exceeded, additional charges may be levied depending on the delay.
ARTICLE 4. CHARACTERISTICS OF THE ACCOMMODATION AND TAKING POSSESSION, ADDITIONAL SERVICES
Rooms and suites are available from 4pm and must be vacated by 12 noon on the day of departure.
The hotel, rooms and suites are entirely non-smoking, which the Client undertakes to respect. Failing this, the company DOMAINE DE LOCGUÉNOLÉ may apply a penalty corresponding to the cost of cleaning the room, in addition to a penalty of €150 per day.
Dogs weighing less than 12kg are allowed on the premises, on a lead, with the following exceptions, meeting rooms, restaurants and spa.
Unless otherwise agreed by DOMAINE DE LOCGUÉNOLÉ, children under 6 years of age are not admitted to the Spa for massage services, however access to the swimming pool and jacuzzi is authorised only if they are accompanied and under the supervision of an accompanying adult. DOMAINE DE LOCGUÉNOLÉ may refuse access to the jacuzzi and sauna for pregnant women. Furthermore, massage services may not be provided before the 3rd month of pregnancy.
ARTICLE 5. FORMATION OF THE CONTRACT & BOOKING PROCESS
5.1 Formation of the contract
The contract is formed between the company DOMAINE DE LOCGUÉNOLÉ and the Client as soon as agreement has been reached on the Services and the dates on which they are to be carried out.
When a reservation is made by telephone, the company DOMAINE DE LOCGUÉNOLÉ will send an e-mail confirming that the reservation has been taken into account and containing the characteristics of the Services and these GTS prior to confirmation of the reservation by the Customer.
The company DOMAINE DE LOCGUÉNOLÉ sends the Customer an e-mail confirming the reservation with the characteristics of the Services reserved.
In the absence of a confirmation email, the Client must contact the hotel to check the status of his/her reservation.
5.2 Booking process
All Service orders can be placed on the Site by choosing the Service and following the instructions provided.
Before making any reservation, the Customer must complete the information requested on the reservation request form.
The reservation procedure includes the following steps:
Step 1: The Customer clicks on the "Book" link for one of the room or suite categories or "Book this room" after clicking on the "Discover the room category" link. The Customer is then directed to a web page to check availability.
Step 2: The Customer checks availability by specifying the dates on which they wish to book a room, the number of people (by age) and any promotional code, and confirms their criteria by clicking on the "check availability" link,
Step 3: The Customer clicks on the room of their choice by clicking on the rate. The Customer must then make sure that all the information displayed is consistent with their details (date, time, rooms, prices, etc.); The Customer can finalise their booking by requesting a spa reservation and/or bike hire. The information cannot be changed once the reservation has been finalised in accordance with step 6. The Customer may go back at any time before finalising the booking by using their browser to modify their booking.
Step 4: The Customer clicks on "Book" and is directed to a summary of their order. To make a reservation, they must then fill in the form with the minimum information required: title, first name, surname, email address, country of residence and telephone number. The Customer must also indicate whether they wish to take out the cancellation insurance offered by DOMAINE DE LOCGUÉNOLÉ's partner. The Customer must then click on the "confirm my booking" link after ticking the box "I have read the Tariff Terms and Conditions and Privacy Policy, and confirm that I understand and accept them".
Step 5: The Customer is directed to a payment page to validate their booking. To do this, they must enter their payment details (credit card) and click on "Confirm booking". The contract is then validly concluded and binding on the Customer. The payment details are provided by the Customer as a guarantee of the booking, provided that the service chosen is a flexible offer; if it is a non-cancellable, non-refundable offer, payment will be made immediately.
Step 6: The company DOMAINE DE LOCGUÉNOLÉ will send the Client, as soon as possible by e-mail, an acknowledgement of receipt confirming the reservation, including the essential elements such as the identification of the Service ordered, the price and the quantity.
All the information contained in this reservation confirmation e-mail will be deemed to constitute the agreement between the Client and the company DOMAINE DE LOCGUÉNOLÉ if the Client has not contested it by registered letter with acknowledgement of receipt within 8 days of receiving the confirmation e-mail.
In the event that the client does not receive a booking confirmation, he/she must contact the company DOMAINE DE LOCGUÉNOLÉ.
ARTICLE 6. PRICES AND PAYMENT
The prices relating to the booking of Services are indicated before, during and after the booking.
For Accommodation Services, the prices indicated are net per room for the number of person(s) and date selected.
When an accommodation reservation is confirmed, the total price is indicated to the Customer in euros, including tax, and is valid only for the period indicated on the Site.
Unless otherwise stated on the Site, options (for example, breakfast, half-board, full-board, etc.) that are not offered at the time of booking the Service are not included in the price.
The tourist tax, presented when booking the Service, must be paid directly to DOMAINE DE LOCGUÉNOLÉ .
As a general rule, prices do not include all expenses of a personal nature or room accessories, such as civil protection insurance (for access to the spa), laundry, telephone, drinks, room service, tips and, more generally, any service not expressly included in the booking confirmation.
Prices include VAT applicable on the day of booking and any change in the VAT rate will automatically be reflected in the price indicated on the invoice date.
Any change or introduction of new legal or regulatory taxes imposed by the competent authorities will automatically be reflected in the price indicated on the invoice date.
Lastly, certain promotional offers are only available on the Site and are sold exclusively on the Internet and under no circumstances at the Domaine de Locguénolé reception desk.
ARTICLE 7. PAYMENT TERMS
The Customer provides his/her bank details as a guarantee for the booking by credit or debit card (Carte Bleue, Visa, Mastercard, American Express, this list being subject to change) by entering the card number directly in the area provided for this purpose (entry secured by SSL encryption), with no spaces between the digits, as well as its date of validity (valid on the date of the stay) and the visual cryptogram in the case of payment or prepayment.
Payment for the Services booked will be made :
- Or at the time of booking for non-cancellable / non-changeable / non-refundable Services;
- Or on site at DOMAINE DE LOCGUÉNOLÉ on the day of their stay, in all other cases and for any additional services not paid for at the time of booking. The customer may be asked to show proof of identity in order to prevent credit card fraud.
In the event of payment by bank or debit card, the Customer will be debited as soon as payment has been validated. The commitment to pay given by means of a payment card is irrevocable.
The company DOMAINE DE LOCGUÉNOLÉ may, two weeks before the day of the customer's arrival, issue an authorisation to debit the bank card in order to guarantee payment of the sums corresponding to the services booked for the best price offers. When the customer makes a reservation on line for a flexible offer, his/her account is not debited: only an imprint of his/her credit card is recorded for security reasons.
By communicating the information relating to his/her bank card, the Client authorises the company DOMAINE DE LOCGUÉNOLÉ to debit his/her bank card for the amount corresponding to the all-inclusive price when booking prepaid offers.
The Customer guarantees that he/she is fully authorised to use the means of payment used to pay for his/her order and that this means of payment gives access to sufficient funds to cover all costs resulting from the purchase of Products on the Site.
The Client's payment card is subject to a validity check by this partner and may be refused in particular in the event of theft of the card, blocked card, ceiling reached, etc. In the event of a refusal, the Client must contact his/her bank and the company DOMAINE DE LOCGUÉNOLÉ to ensure that the payment is valid.
If the Customer does not show up at the hotel and has not cancelled his/her reservation in accordance with the applicable cancellation conditions, the price of the Services will be debited in accordance with the cancellation conditions chosen.
If the Client is a professional, any payment made after the agreed due date will automatically and without formalities result in the payment of a late payment penalty based on the outstanding sums, equal to three times the legal interest rate in force on the due date plus 10 points, with a minimum of €100. The hotel may also ask the client to pay a fixed indemnity of a minimum of €40 to cover the administrative and collection costs incurred in dealing with the unpaid amount.
SECTION 8. CANCELLATIONS AND MODIFICATIONS BY THE CUSTOMER
If the Customer has subscribed to an offer with the possibility of cancellation, the Customer may cancel the Services 48 Hours before the day of arrival, i.e. no later than 3 p.m. Paris time on the day before the first day of the reservation. In this case, no amount will be debited from the card entered on the day of booking. In the event of a late cancellation or a no-show by the Client on the day of the reservation, the company DOMAINE DE LOCGUÉNOLÉ will debit the credit card provided at the time of the reservation for the amount of the Service and any additional services for the first night.
If the Customer has subscribed to an offer with the possibility of cancellation, the Customer may modify the reservation in writing at least 48 hours before the day of arrival, i.e. no later than 3 p.m. Paris time on the day before the first day of the reservation. The difference in price will be invoiced.
In other cases, reservations are firm and the price of the Services will be deducted from the reservation and may not be reimbursed in the event of cancellation, all sums paid by the Client being retained by the company DOMAINE DE LOCGUÉNOLÉ as a deposit within the meaning of Articles 1590 of the Civil Code and L. 214-1 of the Consumer Code. The deposit will not be reimbursed; it corresponds to the amount of the Services debited, i.e. the total amount indicated at the time of reservation and, where applicable, the price of the options selected by the Customer.
Without prejudice to the foregoing provisions, in the event of the Client's failure to appear on the first and second days of the booking of the Service, the Client's booking will be cancelled in its entirety and the company DOMAINE DE LOCGUÉNOLÉ will put the Services back on sale.
The Customer is reminded of article L. 221-28 of the French Consumer Code, which excludes accommodation services from the right of withdrawal:
The right of withdrawal cannot be exercised for contracts :
[...]
12° The provision of accommodation services, other than residential accommodation, goods transport services, car rental, catering or leisure activities that must be provided on a specific date or during a specific period;
In application of this article L. 221-28 al. 12, the Customer does not have the right of withdrawal for the reservation of accommodation services provided for a specific date or period.
Consequently, the accommodation services ordered on the Site are subject exclusively to the cancellation and modification conditions identified on the Site.
If the Customer has subscribed to an offer with the possibility of cancellation, the Customer may cancel the Services 48 Hours before the day of arrival, i.e. no later than 3 p.m. Paris time on the day before the first day of the reservation. In this case, no amount will be debited from the card entered on the day of booking. SECTION 9. OBLIGATIONS AND LIABILITY OF THE CUSTOMER
The Client is solely responsible for his choice of Services on the Site and their suitability to his needs. DOMAINE DE LOCGUÉNOLÉ may not be held liable in this respect.
The Customer undertakes to pay the prices of the Services definitively booked. Any fraudulent, irregular or incomplete payment will result in the immediate cancellation of the Services, even if the contract has been concluded. The Customer undertakes to comply with the special conditions applicable within the hotel.
In particular, they must wear appropriate and correct clothing at all times (particularly when going to and from the Spa) and in the L'INATTENDU restaurant, and behave appropriately towards hotel staff and other guests.
The Client also undertakes to ensure that the IT resources made available by the hotel (in particular the Wi-Fi network) are not used in any way for the purposes of reproducing, representing, making available or communicating to the public works or objects protected by copyright or related rights, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorisation of the holders of the rights provided for in Books I and II of the Intellectual Property Code, where such authorisation is required. The Customer must accept the policy on security and use of IT resources prior to any use.
The Client must not smoke in the hotel, rooms, restaurants or Spa. They must not under any circumstances disrupt the smooth running of the hotel or compromise the safety of the establishment or persons. If this is the case, DOMAINE DE LOCGUÉNOLÉ may apply a penalty of €150 per person.
Generally speaking, the Client must behave correctly at all times and refrain from any behaviour that is contrary to public decency and order, or contrary to the applicable internal regulations, where applicable. Failing this, the hotel manager or any other authorised person may ask the Client to leave the hotel without any compensation being due or any refund being made. If the Client has not paid the price of the Services, he/she must pay immediately before leaving the hotel.
The Customer is solely responsible for his/her car, items in the safe and personal belongings left in the changing rooms or spa cabin.
ARTICLE 10. OBLIGATIONS AND LIABILITY OF THE HOTEL
The company DOMAINE DE LOCGUÉNOLÉ undertakes to provide the Services in accordance with the GTCS and the Special Conditions with the diligence and competence of a good professional.
In this respect, it is only bound by an obligation of means.
DOMAINE DE LOCGUÉNOLÉ endeavours to publish photographs and texts to illustrate the Services as faithfully as possible. However, it should be noted that variations may occur, in particular due to the fact that the presentation is made by category and that changes in decoration and furniture may be made in the rooms and places where the Services are provided. Consequently, the Customer will not be entitled to claim any compensation, and will not be able to cancel his/her reservation due to variations that do not concern the essential characteristics of the Services.
In the event of it being impossible to carry out the Service or in the event of force majeure, and in particular to make the reserved room available to the Client, the company DOMAINE DE LOCGUÉNOLÉ reserves the possibility of having the Client totally or partially accommodated in a hotel of equivalent category for services of the same nature, subject to the prior agreement of the Client. The company DOMAINE DE LOCGUÉNOLÉ retains responsibility for the reasonable costs involved in the transfer, to the exclusion of any compensation.
In any event, the company DOMAINE DE LOCGUÉNOLÉ may not be held liable for any indirect damage resulting from the performance of the Services, such as loss of business, loss of customers, loss of image.
ARTICLE 11. PERSONAL DATA
The Client is hereby informed that for the purposes of booking, executing and invoicing the Services, managing the client account and monitoring the commercial relationship, the company DOMAINE DE LOCGUÉNOLÉ collects and processes the Client's personal data.
Certain information is compulsory for the reservation and execution of Services, and is indicated as such on each form on the Site. This information is confidential.

The Client has a right of access, rectification, deletion, updating, limitation and opposition on legitimate grounds to the personal data concerning him. They simply need to write to the company DOMAINE DE LOCGUÉNOLÉ , using the contact details given at the top of the GSTS, stating their surname, first name and email address. In accordance with the regulations in force, the request must be signed and accompanied by a photocopy of a signed identity document and must specify the address to which the reply should be sent. A reply will be sent within one month of receipt of the request.
Customers can also consult or modify their personal details on their account directly on the Site.
If you have any difficulty in managing your personal data, you can lodge a complaint with the CNIL.

ARTICLE 12. APPLICABLE LAW AND DISPUTES
These GTS and any contract relating to the performance of the Services are governed by French law.
In the event that the Customer is a professional, any dispute arising from the formation, interpretation, performance or termination of the contract relating to the Services shall be submitted to the competent courts within the jurisdiction of the registered office of the company DOMAINE DE LOCGUÉNOLÉ.
In the event that the Customer is a consumer, these GTS do not preclude the application of the mandatory protective provisions applicable in the Customer's country of residence.
The Customer is informed that in the event of failure to resolve a dispute amicably after having referred the matter to the company DOMAINE DE LOCGUÉNOLÉ, and in the event of a negative response or no response within a period of 60 days from the date of referral, the Customer may refer the matter to the Tourism and Travel Ombudsman at the address "Médiateur Tourisme Voyage - MTV Médiation Tourisme Voyage - BP 80303 - 75823 Paris Cedex 17" or online at the following Internet address: https://www.mtv.travel/saisir-le-mediateur/
